Have you reviewed your leave policies lately?  If not, now is the time.  States (and cities and counties) across the nation are passing paid sick leave laws at an ever increasing pace and this trend is moving full steam ahead.  As accruals, accrual caps, etc. vary from state to state and city to city, remaining compliant is no small undertaking.

As of May 6th, 2019, the following states have some type of mandated paid leave law.

  • Arizona
  • District of Columbia
  • Connecticut
  • California
  • Maryland
  • Massachusetts
  • New Jersey
  • Oregon
  • Rhode Island
  • Washington
  • Vermont

As of May 6th, 2019, the following cities and counties also have some type of mandated paid leave law.

  • Duluth, MN (effective 1/2020)
  • Emeryville, CA
  • Minneapolis, MN
  • Montgomery County (MD)
  • New York, NY
  • Oakland, CA
  • Philadelphia, PA
  • Pittsburgh, PA
  • San Diego, CA
  • San Francisco, CA
  • Santa Monica, CA
  • Seattle, WA
  • Tacoma, WA
  • West Chester County, NY (effective 4/2019)

The San Antonio, TX paid sick leave ordinance is scheduled to start 8/2019 for employers with more than five employees.  Austin, TX also passed a paid sick leave law.  However, on August 17, 2018, the Texas Court of Appeals, Third District, issued an order temporarily enjoining Austin’s ordinance from taking effect until the appeal is resolved.
